GUEST ASSUMPTION OF RISK, RELEASE & ACKNOWLEDGMENT

 

Please read this document carefully before entering or participating in activities on the property.

The Ozarks Church of Nature & Magical Food Forest is a rural working homestead, agricultural property, developing medicinal food forest, wildlife habitat, and natural environment. It is not a paved commercial recreation facility.

By signing below, I acknowledge that I am voluntarily entering and participating in activities on private rural property and accept the ordinary and inherent risks associated with doing so.

  1. NATURAL AND WILDERNESS RISKS

I understand that the property includes natural and potentially hazardous conditions, including but not limited to:

  • Uneven, rocky, steep, muddy, or slippery terrain
  • Loose gravel
  • Exposed roots
  • Holes, ditches, slopes, and natural drops
  • Fallen limbs and trees
  • Forested areas
  • Tall grass and dense vegetation
  • Extreme heat, cold, humidity, storms, wind, lightning, and rapidly changing weather
  • Ticks, mosquitoes, stinging insects, spiders, and other insects
  • Venomous snakes and other native wildlife
  • Naturally occurring allergens, plants, fungi, and environmental conditions
  • Springs, wet areas, ponds, drainage areas, and other natural water features

I understand that these conditions are part of the natural character of the property and may not always be marked, fenced, or individually identified.

 

  1. FARM ANIMALS, LIVESTOCK, AND WORKING DOGS

I understand that this is an active homestead and agricultural environment.

Animals on or around the property may include:

  • Goats
  • Livestock guardian dogs
  • Farm cats
  • Poultry
  • Wildlife
  • Other domestic or agricultural animals

Animals can behave unpredictably.

They may run, jump, push, scratch, bite, kick, step on feet, knock someone down, defend territory or livestock, or react unexpectedly to unfamiliar humans or animals.

I agree to follow all instructions regarding livestock, working dogs, animal enclosures, gates, feeding, handling, and restricted areas.

I will not enter animal enclosures, handle animals, feed animals, open gates, or interfere with working livestock guardian dogs without permission.

 

  1. FARM EQUIPMENT, TOOLS, AND INFRASTRUCTURE

I understand that the property may contain or utilize:

  • Tractors and other machinery
  • Mowers
  • Power tools
  • Hand tools
  • Fencing
  • Solar equipment
  • Generators
  • Propane systems
  • Wells
  • Septic or alternative sanitation systems
  • Gardens and irrigation systems
  • Construction materials
  • Working areas
  • Fire pits
  • Outdoor cooking areas
  • Other agricultural or off-grid infrastructure

I agree not to operate equipment, machinery, tools, or infrastructure without permission.

 

  1. PERSONAL RESPONSIBILITY

I agree to exercise reasonable care for my own safety while on the property.

I understand that I am responsible for:

  • Wearing appropriate footwear and clothing
  • Staying hydrated
  • Protecting myself from heat, insects, ticks, sun exposure, and weather
  • Avoiding areas or activities beyond my own physical ability
  • Following posted rules and reasonable safety instructions
  • Remaining aware of animals, terrain, machinery, and other natural hazards

If I have a health condition, physical limitation, allergy, sensitivity, or other concern that may affect my ability to safely participate in an activity, I am responsible for making appropriate decisions about my own participation.

 

  1. MINORS

If I bring a minor onto the property, I affirm that I am the minor’s parent, legal guardian, or otherwise legally authorized to supervise that child.

I accept responsibility for continuously supervising minors in my care.

I understand that children may encounter animals, wildlife, tools, uneven terrain, plants, insects, water features, and other rural hazards.

Children may not enter animal areas, private areas, work areas, or operate tools or equipment without permission and appropriate adult supervision.

 

  1. COMPANION ANIMALS

All visiting animals require prior approval.

If I bring an approved animal onto the property, I accept responsibility for its behavior, supervision, containment, safety, and any damage or injury it causes.

I understand that resident livestock guardian dogs are working animals whose primary responsibility is protecting livestock and property.

My animal must remain safely controlled and may not chase, threaten, attack, harass, or interfere with livestock, wildlife, residents, guests, or working animals.

I understand that bringing an animal into a rural environment may expose that animal to wildlife, insects, rough terrain, livestock, working dogs, and other natural hazards.

I am responsible for feeding my animals and picking up any pet waste.

 

  1. ASSUMPTION OF RISK

I understand that participation in rural, agricultural, outdoor, animal-related, gardening, homesteading, and off-grid activities includes risks that cannot be completely eliminated.

I voluntarily choose to enter and participate with knowledge of those risks.

 

  1. RELEASE AND HOLD HARMLESS

To the fullest extent permitted by applicable law, I release and hold harmless the property owners, Ozarks Church of Nature & Magical Food Forest, authorized hosts, volunteers, and land stewards from claims arising from the ordinary and inherent risks of voluntarily entering or participating in activities on the property.

Nothing in this agreement is intended to waive any right, duty, or liability that cannot legally be waived.

 

  1. PROPERTY RULES

I acknowledge that I am also expected to follow all applicable property rules, including rules concerning:

  • Restricted areas
  • Animals
  • Trash
  • Fire
  • Chemicals and environmental contamination
  • Privacy
  • Conduct
  • Harassment
  • Safety
  • Harvesting
  • Use of tools and equipment

Failure to follow property rules may result in being asked to leave the property.

 

  1. EMERGENCY ASSISTANCE

I authorize reasonable emergency assistance to be requested if I am injured or become seriously ill while on the property and am unable to make that decision myself.

I understand that I remain financially responsible for my own medical care, transportation, or emergency services to the extent provided by law.
